FairOS Terms of Use
Version 1.0
Effective Date: September 13, 2026
These Terms of Use (“Terms”) govern your access to and use of websites, applications, software, and related services provided by FairOS Event Technologies LLC (“FairOS,” “we,” “us,” or “our”), including FairOS: Compete and other FairOS products and services that link to these Terms (collectively, the “Services”).
Please read these Terms carefully. By creating an account, accessing or using the Services, or indicating your acceptance of these Terms, you agree to be bound by them.
If you do not agree to these Terms, do not create an account or use the Services.
1. About FairOS
FairOS provides technology used by fairs, fairgrounds, festivals, associations, event operators, and other organizations to administer programs and operations.
Certain Services, including FairOS: Compete, may be provided on behalf of or in connection with a fair, event, venue, association, government entity, or other organization (each an “Event Operator”).
FairOS is the technology provider. The Event Operator remains responsible for its event, competition, rules, eligibility requirements, entry acceptance or rejection, judging, awards, premiums, schedules, refund policies, and other event-specific decisions unless expressly stated otherwise.
When you participate in an event through the Services, you may also be subject to rules, policies, waivers, terms, or other requirements established by the applicable Event Operator.
2. Eligibility to Use the Services
You must be at least 18 years old and legally capable of entering into a binding agreement to create or control a FairOS account unless FairOS expressly provides otherwise for a particular Service.
The Services are not intended to allow children under 13 to independently create accounts or directly submit personal information to FairOS.
If you use the Services to provide information about, register, enter, or otherwise act on behalf of another person—including a child, dependent, student, club member, organization member, or other exhibitor—you represent that you have the authority necessary to do so.
3. Accounts
Certain Services require an account.
You agree to:
- provide accurate, current, and complete account information;
- maintain and promptly update information when necessary;
- maintain the confidentiality and security of your login credentials;
- use reasonable measures to prevent unauthorized access to your account; and
- promptly notify FairOS if you believe your account has been accessed or used without authorization.
You are responsible for activity occurring through your account to the extent permitted by law.
You may not impersonate another person, create an account using information you are not authorized to use, or permit another person to use your credentials in a manner that circumvents applicable authorization requirements.
4. Acting on Behalf of Other People
Some FairOS Services allow an adult account holder to act on behalf of other individuals.
For example, FairOS: Compete may allow parents, guardians, teachers, schools, clubs, organizations, or other authorized representatives to submit competition entries for exhibitors.
When you provide information or take action on behalf of another person, you represent and certify that:
- you are authorized to provide the information;
- you are authorized to take the requested action;
- the information you provide is accurate to the best of your knowledge; and
- you have obtained any permission, consent, or authorization required by applicable law or by the applicable Event Operator.
Additional certifications may be required before particular transactions or submissions are completed.
5. Competition Entries and Event Rules
FairOS: Compete and similar Services may facilitate competition registration and entry administration.
Submission through FairOS does not guarantee that an entry:
- is eligible;
- will be accepted;
- will be displayed, exhibited, judged, or evaluated;
- will receive an award, premium, ribbon, recognition, or placement; or
- will remain eligible if applicable requirements are not satisfied.
The applicable Event Operator determines competition rules and makes final event-specific decisions unless the Event Operator expressly provides otherwise.
You are responsible for reviewing and complying with the rules applicable to your entries.
For the 2027 Riverside County Fair & National Date Festival Competitive Exhibits, the applicable rules are contained in the official Competitive Exhibits Handbook made available by the Riverside County Fair & National Date Festival.
If information displayed by the Services conflicts with an Event Operator's official published rules, contact the Event Operator or FairOS support before relying on the conflicting information.
6. Accuracy of Entries and Submissions
You are responsible for reviewing information before submitting it.
When you submit a registration, competition entry, payment request, certification, or other transaction through the Services, you represent that the information submitted is accurate and complete to the best of your knowledge.
FairOS or the applicable Event Operator may require correction, review, supporting information, or additional documentation.
Submission timestamps and other system records maintained by the Services may be used to determine whether an action occurred before an applicable deadline.
7. Electronic Transactions and Records
You consent to conducting transactions electronically through the Services.
Electronic actions may include:
- creating an account;
- submitting registrations or entries;
- accepting terms or certifications;
- making or requesting payments;
- receiving confirmations;
- receiving notices and reminders; and
- communicating with FairOS or an Event Operator.
When you check a box, click a submission button, complete a transaction, or otherwise electronically indicate agreement, your electronic action may constitute your signature, consent, certification, or authorization to the extent permitted by applicable law.
FairOS may maintain records showing the text presented to you, the version of applicable terms or certifications, your account or user identifier, the transaction involved, and the date and time of your action.
8. Communications
By providing an email address or other contact information, you agree that FairOS and applicable Event Operators may send transactional or administrative communications related to your account, entries, payments, deadlines, receiving schedules, refunds, security, support requests, or other use of the Services.
These operational communications are part of the Services and are not marketing communications merely because they are sent electronically.
You are responsible for maintaining accurate contact information and for monitoring communications related to time-sensitive transactions.
Delivery of an email is not guaranteed. Event rules and deadlines remain applicable even if a reminder or notification is delayed, filtered, undelivered, or not read.
9. Fees, Payments, and Refunds
Certain Services may facilitate payments to Event Operators or other organizations.
Unless expressly identified otherwise at the time of payment:
- the applicable Event Operator, not FairOS, is the merchant or recipient of event-related fees;
- the Event Operator establishes applicable fees and refund policies; and
- FairOS provides the technology used to facilitate or record the transaction.
Payments may be processed by third-party payment providers such as Square. Your use of a third-party payment service may also be subject to that provider's terms and privacy practices.
FairOS does not guarantee that a payment will be approved by a payment provider or financial institution.
Refund eligibility is determined by the applicable Event Operator's rules and policies. The ability of FairOS software to technically process or record a refund does not create a right to a refund.
10. Intellectual Property
The Services, including their software, interfaces, design, branding, graphics, documentation, databases, and other FairOS-created content, are owned by FairOS or its licensors and are protected by intellectual property and other applicable laws.
Subject to these Terms, FairOS grants you a limited, non-exclusive, non-transferable, revocable right to access and use the Services for their intended purposes.
You may not, except as permitted by law:
- copy or redistribute substantial portions of the Services;
- reverse engineer, decompile, or attempt to derive source code from the Services;
- circumvent access controls or security measures;
- remove proprietary notices;
- use FairOS trademarks without authorization; or
- use the Services to develop or operate a competing service through unauthorized extraction of FairOS data, interfaces, or functionality.
11. Content and Information You Provide
You retain any ownership rights you otherwise have in content or information you submit through the Services.
You grant FairOS a non-exclusive right to host, store, reproduce, process, transmit, and otherwise use submitted content and information as reasonably necessary to:
- provide the Services;
- administer transactions and entries;
- provide information to the applicable Event Operator;
- maintain security and integrity;
- provide support;
- comply with legal obligations; and
- perform other activities described in our Privacy Policy.
This license does not transfer ownership of your content to FairOS.
You represent that you have the rights and permissions necessary to provide content you submit.
12. Event Operator Content
Event Operators may provide rules, schedules, classifications, descriptions, logos, documents, instructions, results, and other information through the Services.
The Event Operator is responsible for the accuracy and substance of Event Operator-provided content.
FairOS may assist in displaying or processing that information but does not independently guarantee its accuracy.
13. Acceptable Use
You may not use the Services to:
- violate applicable law;
- submit fraudulent, false, deceptive, or unauthorized information;
- impersonate another person;
- interfere with the operation or security of the Services;
- probe, scan, or test vulnerabilities without authorization;
- introduce malware or harmful code;
- attempt to access another user's account or information without authorization;
- circumvent eligibility, payment, entry, security, or access controls;
- scrape or extract information through automated means except as expressly authorized;
- overload or disrupt the Services;
- use the Services to harass, threaten, exploit, or harm another person; or
- assist another person in doing any of the foregoing.
FairOS may investigate suspected misuse and may restrict or suspend access when reasonably necessary to protect users, Event Operators, FairOS, or the Services.
14. Third-Party Services
The Services may integrate with or link to third-party products and services, including payment processors, authentication providers, hosting providers, email providers, mapping services, or websites operated by Event Operators.
Third-party services are governed by their own terms and privacy practices.
FairOS is not responsible for third-party services that it does not control, except to the extent responsibility cannot lawfully be excluded.
15. Service Availability and Changes
We work to provide reliable Services, but we do not guarantee uninterrupted or error-free operation.
The Services may occasionally be unavailable because of:
- maintenance;
- updates;
- infrastructure failures;
- Internet or telecommunications failures;
- third-party service interruptions;
- security incidents;
- events outside our reasonable control; or
- other technical or operational circumstances.
We may modify, update, improve, replace, or discontinue features when reasonably necessary.
When a time-sensitive event transaction is affected by a technical problem, contact FairOS support and the applicable Event Operator as soon as reasonably possible.
16. Support
Questions concerning FairOS technology may be directed to:
FairOS Support
support@getfairos.com
Questions concerning competition rules, eligibility, judging, premiums, event operations, or Event Operator policies may need to be directed to the applicable Event Operator.
17. Suspension and Termination
FairOS may suspend or restrict access to the Services when reasonably necessary because of:
- violation of these Terms;
- suspected fraud or unauthorized activity;
- security concerns;
- legal requirements;
- requests from an applicable Event Operator concerning an account under that operator's program; or
- conduct that materially threatens the Services or other users.
You may stop using the Services at any time.
Termination or suspension does not automatically delete records that FairOS or an Event Operator must retain for legitimate business, transaction, security, dispute-resolution, or legal purposes.
18. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
FAIROS DISCLAIMS WARRANTIES THAT ARE NOT EXPRESSLY PROVIDED IN THESE TERMS, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT SUCH WARRANTIES MAY LAWFULLY BE DISCLAIMED.
FAIROS DOES NOT WARRANT THAT:
- THE SERVICES WILL ALWAYS BE AVAILABLE OR ERROR-FREE;
- EVERY NOTIFICATION OR EMAIL WILL BE DELIVERED;
- INFORMATION PROVIDED BY AN EVENT OPERATOR WILL BE ERROR-FREE; OR
- USE OF THE SERVICES WILL RESULT IN ENTRY ACCEPTANCE, AWARDS, PREMIUMS, OR ANY PARTICULAR EVENT OUTCOME.
Nothing in these Terms excludes warranties or rights that cannot legally be waived.
19. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAIROS EVENT TECHNOLOGIES LLC AND ITS OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITY, GOODWILL, OR DATA, ARISING OUT OF OR RELATING TO THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAIROS'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
- THE AMOUNT YOU PAID DIRECTLY TO FAIROS FOR THE SERVICES DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM; OR
- ONE HUNDRED U.S. DOLLARS ($100).
AMOUNTS PAID TO AN EVENT OPERATOR FOR ADMISSION, ENTRY FEES, REGISTRATION, OR OTHER EVENT TRANSACTIONS ARE NOT AMOUNTS PAID TO FAIROS FOR PURPOSES OF THIS LIMITATION UNLESS FAIROS WAS EXPRESSLY IDENTIFIED AS THE SELLER.
These limitations do not apply to liability that cannot lawfully be limited or excluded.
20. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless FairOS Event Technologies LLC and its officers, employees, contractors, and agents from third-party claims, damages, liabilities, costs, and reasonable expenses arising from:
- your material violation of these Terms;
- your unlawful misuse of the Services;
- content or information you knowingly submit without necessary authority or rights; or
- your fraudulent or intentionally wrongful conduct.
This section does not require you to indemnify FairOS for FairOS's own negligence, unlawful conduct, or other liability that cannot legally be shifted to you.
21. Privacy
Our collection and use of personal information is described in the FairOS Privacy Policy, available at:
The Privacy Policy is incorporated into these Terms by reference for purposes of describing our privacy practices, but nothing in these Terms limits rights provided by applicable privacy law.
22. Changes to These Terms
We may update these Terms from time to time.
When we make changes, we will update the version or effective date and make the revised Terms available through the Services or our website.
If a change materially affects your rights or obligations, we may provide additional notice or request renewed acceptance when appropriate or required by law.
Your continued use after an update takes effect constitutes acceptance where permitted by law. If renewed affirmative consent is legally required, continued use alone will not substitute for that consent.
23. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Unless applicable law requires otherwise, any legal action arising out of these Terms or the Services shall be brought in a state or federal court with jurisdiction in California, and the parties consent to the jurisdiction of those courts.
Nothing in this section prevents either party from pursuing a claim in small claims court when eligible or from exercising a right that cannot lawfully be restricted.
24. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect, and the unenforceable provision will be interpreted or modified only to the extent necessary to make it enforceable where permitted by law.
25. No Waiver
Failure to enforce a provision of these Terms does not waive the right to enforce it later.
26. Assignment
You may not assign your rights or obligations under these Terms without FairOS's prior written consent.
FairOS may assign these Terms in connection with a merger, acquisition, corporate reorganization, sale of assets, or transfer of the Services, subject to applicable law.
27. Entire Agreement
These Terms, together with the Privacy Policy and any additional FairOS terms expressly applicable to a particular Service, constitute the agreement between you and FairOS regarding use of the Services.
Event-specific rules and policies constitute separate requirements established by the applicable Event Operator.
